1. Introduction
HammerIO (hammerio.com) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Title 17, United States Code, Section 512, we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent identified below.
This DMCA Policy outlines our procedures for handling copyright infringement claims, including how to submit a notice of alleged infringement, how we process such notices, and how affected parties may submit a counter-notification if they believe their content was removed in error.
2. Notification of Alleged Copyright Infringement
If you believe that content available on or through HammerIO infringes one or more of your copyrights, please submit a written notification ("DMCA Takedown Notice") to our designated copyright agent containing the following information:
- Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works. Please be as specific as possible, including the title, registration number (if applicable), and a link to the original work if available online.
- Identification of the infringing material — A description of the material that you claim is infringing and that you request be removed or access to which be disabled, along with information reasonably sufficient to permit us to locate the material. Providing URLs in the body of your notice is the most effective way to help us identify the allegedly infringing content quickly.
- Your contact information — Your full legal name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
- Statement of good faith — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly being infringed.
- Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
3. Designated Copyright Agent

We strongly recommend consulting with a legal professional before submitting a takedown notice, as submitting a false or fraudulent notice may result in legal liability under Section 512(f) of the DMCA.
4. Processing of DMCA Notices
Upon receipt of a valid DMCA Takedown Notice, we will take the following steps:
- Review the notice for completeness and compliance with DMCA requirements
- Remove or disable access to the allegedly infringing material promptly
- Notify the content provider, member, or user who posted the material that it has been removed or disabled (if applicable)
- Provide the content provider with information about how to submit a counter-notification
We aim to process all valid DMCA notices within 5 business days of receipt. However, complex cases may require additional time for review and investigation.
5. Counter-Notification
If you believe that material you posted on HammerIO was removed or disabled as a result of a mistake or misidentification of the material, you may submit a written counter-notification ("Counter-Notice") to our designated copyright agent. Your Counter-Notice must contain the following information:
- Identification of removed material — Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (including the URL).
- Your contact information — Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which HammerIO may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Statement under penalty of perjury — A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Signature — Your physical or electronic signature.

6. Processing of Counter-Notifications
Upon receipt of a valid Counter-Notice, we will:
- Forward a copy of the Counter-Notice to the original complaining party
- Inform the original complaining party that the removed material will be restored or access re-enabled in 10 to 14 business days unless the original complaining party files a court action against the content provider
- Restore the material or re-enable access to it within 10 to 14 business days after receiving the Counter-Notice, unless our designated agent first receives notice from the original complaining party that they have filed a court action seeking to restrain the content provider from engaging in the infringing activity
7. Repeat Infringers
In accordance with the DMCA and other applicable laws, HammerIO has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
8. Good Faith and Misrepresentation
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney's fees, incurred by the alleged infringer, the copyright owner or its licensee, or the service provider.
Before submitting a DMCA Takedown Notice or Counter-Notification, please carefully consider whether the use of the material at issue constitutes fair use. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notice with us. Filing a false claim under the DMCA is perjury.
9. Fair Use Considerations
Before submitting a DMCA notice, please consider whether the use of the copyrighted material falls under the doctrine of fair use as defined in Section 107 of the Copyright Act. Fair use considerations include:
- The purpose and character of the use, including whether it is commercial or for nonprofit educational purposes
- The nature of the copyrighted work
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole
- The effect of the use upon the potential market for or value of the copyrighted work
HammerIO respects fair use and will consider fair use arguments when evaluating both takedown notices and counter-notifications.
10. Modifications to This Policy
HammerIO reserves the right to modify this DMCA Policy at any time. Any changes will be effective immediately upon posting the updated policy on this page. We encourage you to review this policy periodically for updates. Your continued use of HammerIO after any modifications to this DMCA Policy constitutes your acceptance of the updated terms.
